Skyline Community Edition terms

Version 1.0 — Effective Date: 15 June 2026

These Community Edition Terms govern Customer's access to and use of the DataMiner Community Edition (the "Community Edition"). They supplement the Skyline General Terms and Conditions. Capitalized terms not defined here have the meaning given in the Skyline General Terms and Conditions. In the event of conflict, these Community Edition Terms prevail with respect to the Community Edition to the extent of the inconsistency.

1. Acceptance

By downloading, installing, accessing, or using the Community Edition, Customer accepts these Community Edition Terms and the Skyline General Terms and Conditions. If Customer does not accept them, Customer must not use the Community Edition.

2. Community Edition

The Community Edition is an entry-level version of the Software, made available either as a cloud-hosted service or for self-managed deployment. It provides the functionality of the Software subject to technical limitations, including limitations on scale, as described in the Documentation. Skyline may modify the scope, features, or limitations of the Community Edition at any time.

3. No Fees

No fees apply to the Community Edition. The provisions of the General Terms and Conditions relating to fees, invoicing, and payment do not apply to it.

4. No Warranty

The Community Edition is provided "as is" and "as available", without warranty of any kind. The warranties in the General Terms and Conditions do not apply to the Community Edition. To the fullest extent permitted by applicable law, Skyline disclaims all warranties, whether express, implied, statutory, or otherwise, including any warranty of merchantability, fitness for a particular purpose, or non-infringement.

5. Support

No maintenance, updates, upgrades, or formal support are provided for the Community Edition. Skyline may make community-based resources available from time to time, without any commitment to do so.

6. Limitation of Liability

Because the Community Edition is provided free of charge, Skyline's liability is limited to the fullest extent permitted by applicable law. Skyline shall have no liability of any kind arising out of or in connection with the Community Edition, except for liability that cannot be excluded under applicable law, such as liability for fraud, willful misconduct, or in case of death or personal injury caused by negligence. The limitations and exclusions in clause 13 of the General Terms and Conditions apply in addition to, and not in limitation of, this clause.

7. Term and Termination

These Community Edition Terms apply for as long as Customer uses the Community Edition. Skyline may suspend, revoke, or discontinue the Community Edition, in whole or in part, at any time and at its sole discretion, without liability. Upon discontinuation or revocation, Customer's right to use the Community Edition ceases and Customer shall cease all use.

8. Upgrade

Customer may transition to a paid version of the Software at any time. Such use is governed by the General Terms and Conditions and the applicable Quotation.
